By booking services with PinPoint Productions LLC (“Photographer”), the client (“Client”) agrees to the following Terms of Service.

 

1. PROPERTY CONDITION & SHOOT TIME

 

All properties are photographed and/or filmed as-is. Client is responsible for ensuring the property is clean, staged, accessable, and fully photo-ready at the scheduled appointment time.

 

If the property is not ready upon Photographer’s arrival and the shoot exceeds the scheduled time, an additional fee of $100 per hour (or portion thereof) will apply to cover the extra time required.

 

2. SAFETY & LEGAL CONSIDERATIONS

​Photographer reserves the right to refuse to photograph or film any portion of the property if safety, legal, or access concerns arise. Client is responsible for ensuring the property is safe and acceptable for production and that all required permissions for access have been obtained.

3. SCHEDULING, RESCHEDULING & CANCELLATION POLICY

​

Productions are scheduled Monday–Friday during normal business hours. Weekend scheduling is subject to availability and may incur fees of up to $300 per crew member.

​

Rescheduling and cancellation terms:​

​

• Changes made within 24 hours of the scheduled production time incur a 25% rescheduling fee.

• On-site cancellations, refusal to proceed, or failure to provide access at the scheduled time will be charged 100% of the booked service fee.

​

Weather-related reschedules are handled at Photographer’s discretion based on safety and production quality. Photographer is not responsible for delays or cancellations caused by circumstances beyond reasonable control, including weather or property unavailability.

​

4. COMPENSATION, FEES & TRAVEL

​

Payment of 100% of the invoice balance is due upon delivery, unless otherwise agreed to in writing. Deliverables will be withheld until payment is received in full.

​

Outstanding balances incur a 10% late fee every 30 days. All licenses granted may be revoked if balances remain unpaid for more than 90 days.

​

Travel outside Company’s standard service radius may incur a $100 per person per hour travel fee. Client may cancel the booking if travel fees are declined.

 

5. COPYRIGHT & USAGE RIGHTS

​

All photographs, videos, floor plans, graphics, and media created remain the exclusive intellectual property of PinPoint Productions LLC.

​

Client is granted a non-exclusive, non-transferable license to use the final deliverables solely for marketing the specific property photographed, and only while the listing is active. This license automatically expires once the property is sold, rented, or removed from the market.

​

The license may not be resold, sublicensed, assigned, gifted, transferred, or shared with any third party. RAW files are not included.

 

Photographer retains the irrevocable right to use all media for marketing, self-promotion, portfolio display, advertising, websites, and social media.

 

6. LIABILITY & INDEMNIFICATION

 

Photographer’s total liability for any claim, loss, or damages arising from the services provided shall be strictly limited to the professional fees paid by Client for the specific shoot.

 

Client warrants that all necessary permissions, consents, and authorizations for access to and photographing the property have been obtained, and is responsible for securing all required location releases, permissions, and approvals related to the property and surrounding areas.

 

Photographer assumes no responsibility for:

• Property damage

• Personal injury

• Legal or regulatory issues

• Misrepresentation claims related to the property

 

Client agrees to indemnify, defend, and hold harmless Photographer from any claims, damages, liabilities, or legal proceedings arising out of the photographing or marketing of the property

7. DELIVERY & INSPECTION

​

Edited photographs are typically delivered within 24–48 hours following the shoot. Video, floor plans, virtual tours, or additional services may require additional time.

 

Client must review and inspect all delivered media within three (3) days of delivery. After this period, the work is considered accepted, and Photographer shall have no further liability or obligation.

8. INDEPENDENT CONTRACTOR STATUS

​

PinPoint Productions LLC operates as an independent contractor. Nothing in this agreement creates an agency, partnership, joint venture, or employer-employee relationship between Photographer and Client.

​

9. GOVERNING LAW

​

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, with venue in Collier County, Florida.

​

10. GENERAL TERMS

​

This Agreement constitutes the entire agreement between the Parties and supersedes all prior discussions, representations, or agreements, whether written or oral.

​

Failure by Photographer to enforce any provision of this Agreement shall not be deemed a waiver of future enforcement of that or any other provision.

​

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

​

This Agreement shall be binding upon the Parties and their respective heirs, successors, and permitted assigns.
